Ask Smithy Xtra Ford Ghia Territory issues

My 2009 Ford Ghia Territory has done 38,000 km and so far the front diff has been replaced, the transfer case has been replaced, the back door has been in the paint shop twice, there has been a major leak at the side door and the carpet has been stained, and now the rear diff needs replacing. Ford has accepted the problems and the service has been fine, and there has been no problem with the staff at dealership. The service staff has told me that these issues are rare and I am unlucky, but the car is leased for five years and I am stuck with it, and I am now concerned about what else might go wrong with it and have asked the dealer to consider replacing it. Is this reasonable considering the problems? Are there other options? I understand Ford is only responsible for fixing it, but at what point is it up to Ford to simply say that it is more than bad luck with regards to this car?

That is a really bad run, one that in other countries might have the car officially labeled a ‘lemon’. But as we don’t have ‘lemon’ laws the carmaker doesn’t have to replace the car or refund your money. But they are responsible for fixing it. I don’t believe you will have any success in getting the car replaced, but you could try pressing the dealer/Ford for an extended warranty.

Under the Australian Consumer Law introduced in January 2011, a consumer can request a refund or a replacement for persistent problems if the car doesn’t do the job it’s supposed to do.
