Nissan X-Trail 2009: Engine growling sound

Two years after buying a new Nissan X-Trail in 2009 the engine started 'groaning' when accelerating. When it was checked we were told it was a 'rattle' coming from the air box surround, which was then insulated and supposedly fixed, but the noise was still there when I drove away from the dealership. I then took my car to another Nissan Service Centre where it was found that the top of air box housing had loosened over. They 'modified' and insulated the cover and all was claimed to be okay. I mentioned the growling noise on acceleration and they found the air box was worn and causing the rattle and required replacement at a cost of $945.65. I refused, as it should have been seen to when under warranty. I do not wish to pay for something that I complained about and should have been checked before the warranty ran out. Nissan suggested they do it as gesture of 'goodwill', but I haven't been able to get any further with them, and have given up. Soon after, when I needed to replace a blown fuse I found that the air box has zippy ties around it. Is this the 'modification' they mentioned? What can I do to get this fixed?

It seems Nissan has agreed to fix the issue under goodwill, so I would start by going back to the company and get that happening. If you don't feel you can do that, there's no other option but to pay for the replacement air box yourself.
